CCPA and ASCI work to improve India’s advertising laws.

 

Globally, advertising self-regulators collaborate closely with governments through both official and informal modes of co-regulation. These collaborations become more important for efficient advertising regulation given the complexity of today’s advertising and the global reach of the internet, where problems like deepfakes, fraud, and disguised advertising are becoming more visible.

The protection of customer preferences is a shared objective of the Advertising Standards Council of India (ASCI) and the Department of Consumer Affairs (DoCA). When it comes to the problem of deceptive advertising, this goal is essential to the missions of the Central Consumer Protection Authority (CCPA) and ASCI.
The Consumer Protection Act of 2019 and its implementing regulations may be violated by advertisements. Accordingly, the CCPA has asked ASCI to send any such advertisements to the CCPA for possible enforcement action. When ASCI receives a complaint about deceptive advertising, it will swiftly be investigated and handled in strict compliance with the Consumer Protection Act 2019 by the CCPA.

Relationship between ASCI and CCPA: Promoting Equality and Clarity in Digital Advertising

This partnership is taking place in the midst of an increasingly complicated advertising environment, particularly in relation to digital advertising.
“The alignment between ASCI’s code and CCPA’s guidelines highlights a collective effort towards promoting transparency and fairness in advertising,” stated Rohit Kumar Singh, secretary of DoCA, in response to this development. Since their goals are similar, the CCPA and ASCI can cooperate to make sure that any violations are dealt with efficiently. Digital advertising is posing new obstacles, and staying up to date necessitates working cooperatively with groups that share similar values.”

It is a well-established best practice for regulators to collaborate closely with self-regulators, and we expect that this relationship will further improve the effectiveness of Indian advertising regulation. The CCPA has the authority to impose fines and penalties in cases where repeat offenders or voluntary compliance with the guidelines is not forthcoming. When necessary, we won’t hesitate to enforce the Consumer Protection Act’s requirements.”
